General Data Protection Regulation (GDPR).

In Revista Wildflower Mexico S.A.S. de C.V. we respect the privacy of all our customers and users of the website, therefore, in our eagerness to offer the best products and services we consider the adaptation to the General Data Protection Regulation (RGPD) as an important pillar to fulfill.

Our team has worked these last two years to test and adapt our applications and services to the GDPR in everything that was necessary. In any case, and although we do not expect any impact, we consider it necessary to provide you in the simplest and most accessible way with all the information about compliance with the new data protection regulations that will be applicable from May 25, 2018.

What does the GDPR consist of?

This new regulation has been made to establish consistent and uniform data protection standards across Europe and applies to companies/legal entities that are based in any EU country, as well as international companies that process data relating to individuals from those countries.

Although many of the principles of the GDPR are based on current EU data protection rules, this regulation is broader in scope, sets more prescriptive standards and imposes substantial penalties. Among some of its new features are stricter consent rules, expanded rights of individuals regarding access, portability and retention. It also establishes important compliance measures whereby a company's supervisory body may impose fines of up to a maximum of €20,000,000 or, in the case of a company, an amount equivalent to 4% of the total annual global turnover of the previous financial year, in the event of certain infringements, whichever is greater.

Rights and commitments.

In order to ensure the privacy and protection of personal data of our customers and users, the RGPD gives individuals 8 fundamental rights. Revista Wildflower Mexico S.A.S. de C.V. undertakes to provide all individuals with due attention and response in due time in case they exercise one or more of their rights. To do so, they can send an email to the following account: This email address is being protected from spambots. You need JavaScript enabled to view it.

In a simple way, the rights that can be exercised are the following:

Right to information: this means that any individual can know at any time what data is handled/stored about him/her, the reasons or purposes for its collection, as well as its possible assignment or transfer of data to third parties.

Right of access: the possibility of being provided with a copy of all the data we handle or store about you.

Right of rectification: in case you detect that your data is not updated or is incorrect, you can request that we make the appropriate and necessary changes to correct it.

Right of deletion/cancellation or "right to be forgotten": at any time you can request the cancellation/deletion of all the data we process about you, removing all your personal information from our databases. If deletion is not technically possible, we will apply pseudonymization or anonymization of the data. If deletion is not possible for legal reasons (e.g. retention of invoices within the legal deadlines), we will block the data and delete any data that is not essential. In any case, you will be duly informed in response to your request of any of the assumptions in which we find ourselves.

Right of opposition: you can oppose to one or more processing of your data at any time and without any justification (e.g. cancel the sending of informative emails...).

Right to withdraw consent: in the same line as the previous right, you can withdraw the consent previously granted to process your data for a particular purpose, without this implying, a priori, a limitation on the use of products or services. In the case of sending commercial communications, the user or customer may revoke consent either through email This email address is being protected from spambots. You need JavaScript enabled to view it. or through the link included in each communication for this purpose.

Right to data portability: you may request that we send you a copy of the personal data concerning you in a structured, commonly used, machine-readable format or we may transfer your personal data to a third party.

Right not to be subject to automated individualized decisions (including profiling): Revista Wildflower Mexico S.A.S. de C.V. does not automatically make individualized decisions with the data we collect from you on our websites. Thus, no decision affecting you or your rights will be made without the intervention of our employees for the purpose of providing you with a service with express acceptance of all conditions.

With respect to our commitments, Revista Wildflower Mexico S.A.S. de C.V. guarantees:

Transparency: one of our main objectives is to provide maximum information and training to our customers and users, in this way, we intend to enable the best experience, appropriate to regulatory standards.

Accountability: we are responsible for our practices regarding the use and storage of the data we may process and we have strong principles and codes of business conduct and ethics for our employees, so that your data cannot be handled outside the purposes for which it was collected.

Privacy: all the data we collect are stored in programs with the highest standards, guaranteeing their privacy.

Security: we have backup copies that guarantee the integrity and recovery of the data.

Legal basis/legitimation.

Based on the RGPD for the processing of personal data is necessary to adequately substantiate and so that it is recorded which is the legal basis that legitimizes the processing of the same. The most important legal bases are:

Contractual compliance: the data processed must be necessary and relevant for the performance of the service or product that has been contracted and therefore must be clearly defined in the contract.

Consent:

Consent is required to be specific, informed and unequivocal, freely expressed by an affirmative and clear act (pre-ticked boxes are not allowed).

The option to refuse consent must be informed.

It is required to have the capacity to contract (appropriate legal age, capacity to act...) or otherwise it must be the parent or legal guardian who must give consent. Our services are not intended for minors, therefore, by signing the contract, the customer declares and guarantees that he/she is of legal age or has the legal capacity to contract.

In case of processing of sensitive or special data, an explicit consent is also required.

Legitimate interests: a legitimate interest must exist that does not conflict with the rights or interests of individuals.

In our case, we base the legal basis of legitimacy on the execution of the contract or provision of services requested or contracted by you by means of an express confirmation on your part of the acceptance of the contract, as well as, if applicable, the remittance of the SEPA mandate. In case you only request information about our products or services, you will be asked for your consent as user/preclient for the inclusion of your data in our databases in order to send you information about the products or services requested, as well as to send promotional mailings about other products or services of our company and related third party companies (group companies) corresponding to the following sectors: publishing, databases, training, fairs and events, software and computer services. The withdrawal of consent to any of these purposes will not condition in any way the execution of the service provision contract that may have been signed. In the contract for the provision of services, as well as in the privacy policy of the web, you can obtain more information about this and the entities to which transfers are made or your data is transferred.

Only those data that are strictly necessary will be collected, and in the event that there is non-mandatory data, you will be duly informed.

Conservation periods.

Revista Wildflower Mexico S.A.S. de C.V. will keep customer data for the duration of their contractual relationship and subsequently for compliance with legal obligations. Likewise, both the data of former clients and preclients or users, will be kept for promotional actions for a period of 5 years, not being kept longer than necessary for the purposes indicated above, without prejudice to the conservation that may be necessary for the formulation, exercise or defense of potential claims and/or whenever permitted or required by applicable law. The data for the management of queries and requests will be kept for the time necessary to respond to them and for a maximum period of 5 years.

The data of curricula for selection processes will be kept during the selection process and up to 2 years after the completion of the same, unless expressly requested beforehand by the applicant.

Security measures implemented.

Revista Wildflower Mexico S.A.S. de C.V. is committed to the fulfillment of the duty of custody and safekeeping of the data as well as its obligation of secrecy, and for this purpose will adopt all necessary measures to avoid its alteration, loss, treatment or unauthorized access, in accordance with the provisions of applicable regulations, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed (whether natural, industrial, unintentional risks or intentional risks arising from human action).

For this same purpose, the supervision, control and evaluation of all processes are continuously maintained to ensure respect for privacy and information security, according to international standards.
